Affiliate Program Terms & Conditions

These Affiliate Program Terms & Conditions (“Terms”) govern participation in the affiliate program (“CAM Affiliate Program”) operated by Canine Arthritis Management Ltd trading as CAM.
Our Affiliate Program allows approved individuals and organizations (“Affiliates”) to promote our educational products and services using a unique affiliate link or promotional code. Affiliates may earn commission on qualifying purchases made by customers they refer to us.
The Affiliate Programme is administered using Tapfiliate.
By registering for, participating in, or using an affiliate link provided through the Affiliate Programme, you agree to these Terms.
1. Eligibility and Acceptance
Applications to the Affiliate Program are subject to our approval.
We reserve the right to accept or reject any application at our discretion.
Affiliates must provide accurate and complete information when registering and must keep their account information up to date.
Affiliates must be at least 18 years old and legally capable of entering into an agreement.
Participation in the Affiliate Program does not create an employment, agency, partnership, joint venture or franchise relationship between the Affiliate and us. Affiliates participate as independent parties.
2. How the Affiliate Program Works
Approved Affiliates will receive a unique tracking link, code or other referral mechanism through Tapfiliate.
Affiliates may share this link with their customers, audience, clients, followers or other appropriate contacts.
When an eligible customer purchases one of our qualifying products or services following a valid Affiliate referral, the Affiliate may earn commission in accordance with these Terms.
Tracking and attribution will normally be determined using the data recorded through Tapfiliate and our associated systems.
3. Commission
Affiliates will receive commission at the rate displayed within their Affiliate account or otherwise agreed with us in writing.
Different products, campaigns or Affiliates may have different commission rates.
Commission is calculated on the qualifying purchase value excluding, where applicable:
• VAT and other applicable taxes;
• refunds;
• chargebacks;
• discounts;
• cancelled transactions; and
• any other amounts which are subsequently returned to the customer.
We may introduce, remove or change commission rates. Where a change affects an existing Affiliate, we will provide reasonable notice where practicable.
4. Qualifying Sales
A sale will qualify for commission where:
1. the customer uses the Affiliate's valid tracking link or other approved referral mechanism;
2. Tapfiliate or our systems successfully attribute the transaction to the Affiliate;
3. the customer completes payment;
4. the transaction is genuine and has not been cancelled, refunded or charged back; and
5. the Affiliate has complied with these Terms.
Commission will not normally be payable where a referral cannot reasonably be attributed to the Affiliate through our tracking systems.
We reserve the right to investigate transactions which appear unusual, fraudulent or inconsistent with these Terms.
5. Commission Payments
Approved commission will be paid [monthly/quarterly], subject to a minimum payment threshold of £[AMOUNT].
Affiliates are responsible for providing accurate payment details.
Affiliates are responsible for declaring and paying any taxes, National Insurance contributions or other liabilities arising from commission payments where applicable.
We may withhold commission while investigating suspected fraud, misuse, refund activity or a breach of these Terms.
6. Refunds and Chargebacks
If a customer receives a full refund, the commission associated with that transaction will be cancelled.
If commission has already been paid, we may deduct the relevant amount from future commission payments.
Where a partial refund is issued, we may adjust the commission proportionately.
The same principle may apply to chargebacks, payment disputes and fraudulent transactions.
7. Affiliate Marketing and Advertising Disclosure
Affiliates must make it clear when they are promoting our products in return for commission.
Affiliate marketing communications must comply with applicable advertising laws, regulations and industry codes, including relevant requirements of the UK Advertising Standards Authority (“ASA”) and CAP Code.
Where required, Affiliates must prominently identify promotional content as advertising, for example by using “Ad” or “#Ad” in a clear and visible position.
Disclosures must be made before or at the point a consumer engages with the promotional content and must not be hidden among hashtags, placed only at the end of content or otherwise presented in a way that could reasonably be overlooked.
Affiliates must not falsely present themselves as independent consumers when promoting our products commercially.
8. Accurate Representation of Our Products
We are an education company and it is important that our products, courses, memberships and educational materials are represented accurately.
Affiliates must not:
• make false, misleading or exaggerated statements about our products;
• guarantee particular educational, professional, financial, clinical or other outcomes unless we have expressly authorised the claim;
• misrepresent the contents, accreditation, certification or recognition of a course;
• claim that our products provide qualifications or professional status unless this is expressly stated by us;
• provide incorrect information about pricing, availability or course content;
• create artificial urgency or make misleading statements about limited availability;
• make claims that we have not made or cannot substantiate; or
• make statements that could reasonably damage our reputation.
Where we provide approved product descriptions, claims, promotional materials or guidance, Affiliates should use those materials wherever reasonably possible.
9. Professional and Ethical Promotion
Affiliates must promote our products professionally, honestly and responsibly.
Affiliate links must not be promoted through:
• spam or unsolicited bulk communications;
• misleading advertisements;
• illegal content;
• discriminatory, threatening or abusive material;
• fraudulent websites or accounts;
• deceptive redirects;
• fake reviews or testimonials;
• impersonation of our company or employees; or
• any activity that could reasonably damage our reputation.
Affiliates must comply with all applicable laws and regulations relating to their marketing activities.
10. Email Marketing
Affiliates may promote our products through their own email lists provided that they have the necessary permission or other lawful basis to contact those recipients and comply with applicable privacy and electronic marketing requirements.
Affiliates must not send unsolicited marketing communications or represent an email as having been sent by us unless we have expressly authorised them to do so.
11. Paid Advertising
Unless we provide written permission, Affiliates must not bid on our company name, brand names, trademarks, product names or confusingly similar terms through Google Ads, Microsoft Advertising or other paid search platforms.
Affiliates must not create advertisements that could reasonably lead customers to believe that the Affiliate's website, account or advertisement is operated directly by us.
Affiliates must not use our brand name within website domains, social media usernames or other identifiers in a way that falsely suggests official ownership or endorsement.
12. Discount Codes and Promotions
Affiliates may only advertise discounts, offers or promotional codes that have been authorised by us.
Affiliates must not create their own discount codes or advertise expired, inaccurate or unauthorised offers.
Where a promotion has an expiry date or other important conditions, these must be communicated accurately.
13. Self-Referrals
Unless expressly authorised by us, Affiliates may not use their own Affiliate link to purchase products for themselves for the primary purpose of generating commission or obtaining an unauthorised discount.
Transactions between closely connected accounts may be reviewed where we reasonably suspect that they have been created primarily to generate Affiliate commission.
14. Intellectual Property
We retain ownership of our trademarks, logos, course materials, graphics, videos, written materials and other intellectual property.
Affiliates are granted a limited, non-exclusive, revocable right to use approved marketing materials solely for the purpose of promoting our products through the Affiliate Program.
Affiliates must not:
• modify our logos or branding in a misleading way;
• claim ownership of our intellectual property;
• reproduce or distribute paid educational content without permission;
• upload our paid course materials to other platforms;
• sell, sublicense or otherwise distribute our intellectual property; or
• create products which could reasonably be mistaken for our official products.
Permission to use our intellectual property ends when the Affiliate leaves or is removed from the Affiliate Programme.
15. Customer Relationship
Customers purchasing through an Affiliate link are purchasing the relevant product or service from us unless explicitly stated otherwise.
We remain responsible for processing the customer's order, providing access to our products and administering applicable refunds.
Affiliates must not make commitments on our behalf or agree to contractual terms with customers on our behalf.
16. Data Protection
Each party is responsible for complying with applicable data protection and privacy laws in relation to personal information it processes.
Affiliates must not collect, store, share or otherwise process customer personal information on our behalf unless specifically authorised to do so.
Information we collect about Affiliates and customers will be processed in accordance with our Privacy Policy and applicable data protection law.
Tapfiliate and other service providers may process information necessary to track referrals, calculate commission and administer the Affiliate Program.
17. Fraud and Manipulation
The following activities are prohibited:
• creating fake purchases;
• generating artificial clicks or traffic;
• cookie stuffing;
• manipulating tracking systems;
• using bots or automated systems to generate referrals;
• deliberately interfering with another Affiliate's attribution;
• submitting false customer information;
• encouraging customers to make transactions solely to generate commission; or
• any other attempt to artificially generate commission.
We may immediately suspend an Affiliate account while suspected fraudulent activity is investigated.
Commission associated with fraudulent or manipulated transactions will not be payable.
18. Monitoring and Compliance
We may monitor Affiliate activity to ensure compliance with these Terms and applicable advertising requirements.
Where we identify marketing that we reasonably believe breaches these Terms, we may ask the Affiliate to amend or remove the material.
Affiliates must comply with reasonable requests about how our brand or products are promoted.
Serious or repeated breaches may result in suspension or termination from the Affiliate Program.
19. Suspension and Termination
Either party may end participation in the Affiliate Program at any time.
We may immediately suspend or terminate an Affiliate where we reasonably believe they have:
• breached these Terms;
• engaged in fraudulent or deceptive behaviour;
• damaged or created a material risk to our reputation;
• breached applicable advertising or marketing rules;
• misrepresented our products;
• misused our intellectual property; or
• otherwise abused the Affiliate Programme.
Following termination, the Affiliate must stop using our Affiliate links and any marketing materials or intellectual property for which permission has been withdrawn.
Valid commission earned before termination will normally remain payable, unless the commission arose from fraud, misuse or a breach of these Terms.
20. Changes to the Affiliate Programme
We may change, suspend or discontinue the Affiliate Programme, including available products, commission structures and programme rules.
Where reasonably practicable, we will provide Affiliates with notice of material changes.
Continued participation following the effective date of updated Terms will constitute acceptance of the revised Terms.
21. Availability and Tracking
We aim to maintain accurate Affiliate tracking but cannot guarantee that tracking technology will always operate without interruption or error.
Technical issues, browser settings, cookie restrictions, ad blockers and other factors may affect referral tracking.
Where a dispute arises regarding attribution, we will review the available information and determine whether a commission is reasonably due.
22. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
To the maximum extent permitted by law, we will not be responsible for indirect or consequential losses arising from participation in the Affiliate Program, including anticipated commission, lost profits or loss of business opportunity.
Our total liability to an Affiliate arising from the Affiliate Program will not exceed the total commission paid or payable to that Affiliate during the 12 months preceding the event giving rise to the claim, except where such a limitation is prohibited by law.
23. Indemnity
The Affiliate will be responsible for losses, claims, costs or liabilities reasonably incurred by us as a result of the Affiliate's unlawful marketing activity, fraudulent conduct, unauthorised claims, infringement of third-party rights or material breach of these Terms, to the extent permitted by law.
24. Governing Law
These Terms are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction over disputes arising in connection with these Terms, subject to any mandatory legal rights that apply.
